You must not allow another person to use your Account, whether temporarily or permanently.

If another individual requires access to climateJob, they must have their own Subscription where multi-user subscriptions are available.

climateJob may offer a Free Trial to eligible new Customers.

The duration of the Free Trial will be displayed at the time of registration and may change from time to time.

The Free Trial currently lasts 30 days, unless a different period is expressly stated when you register.

The duration of any Free Trial applicable to you will be the duration displayed at the point of registration. A change to the standard Free Trial period will not retrospectively alter a trial that has already started.

Where a payment card is required to start a Free Trial:

  • you will not normally be charged when the trial begins

  • your payment details will be securely processed by our payment provider

  • unless you cancel before the Free Trial ends, your Subscription will automatically convert to the applicable paid Subscription

  • the applicable price will be displayed before you begin the trial

  • and the payment method provided by you may be charged when the Free Trial ends

Further details concerning trials, automatic renewal and cancellation are provided in our Subscription and Cancellation Policy.

8. Subscription Fees and Payment

Subscription fees are charged in accordance with the pricing displayed by climateJob at the time you purchase or change your Subscription.

Your Subscription currently provides access for one user.

If climateJob introduces additional Subscription tiers or multi-user functionality, the applicable pricing and user limits will be displayed before you purchase or change your Subscription.

Prices may be displayed exclusive or inclusive of VAT depending on how prices are presented at checkout.

Where VAT or another applicable tax is payable, it may be added at the applicable rate.

Payments are processed through our designated payment provider.

You authorise climateJob and/or its payment provider to charge the payment method associated with your Account for applicable Subscription fees.

If a payment for your Subscription fails, you will have a 48-hour grace period from the time of the failed payment to resolve it, during which your access to climateJob continues as normal.

During this period, a notice will be shown within the application confirming that a payment has failed and how many hours remain to resolve it; Stripe may automatically attempt to collect the payment again; and you can update your payment details at any time via Manage billing within the application, which will prompt an immediate attempt to collect the outstanding payment.

If the payment has not been successfully collected within the 48-hour period, your access to climateJob will be restricted in the same way as for any other lapsed Subscription.

Even where your access has been restricted, you can still open Manage billing to update your payment details, and any successful payment, whether made this way or collected automatically by Stripe, will normally restore your access immediately.

If a separate payment failure occurs after your access has been restored, a new 48-hour grace period will begin from that failure.

Further details concerning Subscription renewal, cancellation and refunds are provided in our Subscription and Cancellation Policy and Refund Policy.

Regulations, guidance, refrigerant classifications and technical requirements may change. You are responsible for verifying that the information provided by climateJob remains appropriate for your circumstances.

13. Automated Calculations and Scheduling

climateJob may use information entered by you to calculate values including refrigerant charge information and CO2e values and to generate reminders or suggested schedules.

The accuracy of these outputs depends partly on the accuracy and completeness of information supplied by you.

climateJob does not guarantee that an automated calculation or scheduling recommendation will identify every applicable legal, regulatory or operational requirement.

You remain responsible for reviewing and acting upon information generated by the Service.

14. Offline Functionality

climateJob may provide offline-first functionality allowing certain features to be used without an active internet connection.

Offline functionality may vary between devices, operating systems and features.

We do not guarantee that every feature will be available offline at all times.

climateJob may allow you to obtain electronic signatures from customers and generate PDF documents based on information entered into the Service.

You are responsible for:

  • ensuring that the information contained within a document is accurate

  • obtaining any required customer authority or consent

  • determining whether an electronic signature is legally appropriate for the particular transaction

  • retaining any records required by law

  • and ensuring that documents are sent to the correct recipient

climateJob does not guarantee that every electronic signature or generated document will satisfy every legal or contractual requirement applicable to your business.

23. Data Storage and Backups

We will take reasonable technical and organisational measures to protect Customer Data.

We may maintain backups as part of our normal operational processes.

However, no online storage system can guarantee that data will never be lost or corrupted.

You should retain independent copies of information that is particularly important to your business or that you are legally required to retain.

25. Termination

Either party may terminate the contractual relationship in accordance with the applicable Subscription and Cancellation arrangements.

We may terminate the Service immediately where:

  • continued provision would be unlawful

  • your use presents a serious security risk

You are responsible for exporting any Customer Data that you wish to retain before the final day of your Subscription.

Your Data After Cancellation. You are responsible for exporting any Customer Data that you wish to retain. Following termination of your Subscription, climateJob will provide a 30-day post-termination data retrieval period. Backup copies will remain appropriately protected and will not ordinarily be processed except where necessary for:

  • disaster recovery

(b) £100.

This limitation does not apply to liability which cannot legally be limited or excluded.

If you continue to use the Service after the updated Terms take effect, your continued use will constitute acceptance of the updated Terms, subject to any rights you may have under applicable law.

32. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where permitted by law.

We may transfer or assign our rights and obligations under these Terms as part of a restructuring, merger, acquisition, sale of the business or transfer of the Service, provided that your rights are not materially adversely affected.

33. No Partnership or Agency

Nothing in these Terms creates a partnership, joint venture, employment relationship or agency relationship between you and climateJob.

Neither party has authority to bind the other.

34. Third-Party Rights

Unless expressly stated otherwise, a person who is not a party to these Terms has no right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.

The remaining provisions will continue in full force and effect.

36. Entire Agreement

These Terms, together with the applicable Subscription and Cancellation Policy, Privacy Policy, Data Processing Agreement, Acceptable Use Policy, Refund Policy and other documents expressly incorporated into them, form the agreement between you and climateJob concerning the Service.

They replace previous agreements or understandings relating to the same subject matter, except where expressly agreed otherwise.

37. No Waiver

If either party does not immediately exercise a right under these Terms, this does not mean that the party has waived that right.

A waiver will only be effective where expressly confirmed in writing.

38. Governing Law

These Terms and any dispute or claim arising from them or the Service will be governed by the laws of England and Wales.
